Conditions of Use

 Our Conditions of Use are as follows for all products that are produced by GCW or it’s affiliates under the names of Wrapster, Kristy’s Creations, The Graphix Hut, CandyGirl, and Wrapster 2.0. Any deviation, whether implied or warranted may constitute a breach of agreement and be punishable under U.S. or Foreign Copyright Laws.

At the time of purchase you are granted a Royalty Free License for all products produce by GCW as outlined above. This license will remian in effect indefinitely provided you adhere to the following conditions:

1. You agree not to provide our products to third parties that have not legally purchased them from our site. This includes posting them as shares, freebies, or gifts. You may not post our products in their raw format on any website, forum, newsgroup, newsletter, blog, or other electronic means..

2. You agree not to include our products in any collection with the intent of delivering them on CD, DVD, FDD, Tape, or other media as part of a collection for free or sale.

3. If you wish to share an item that you have made with our products, we require it to be in a locked format so that our product cannot be extracted from your work. Locked means that an image has been flattened and the layer locked so that it cannot be edited or altered. If you wish to post one of products as a reference, we require that the word SAMPLE be affixed over the product, sufficiently to cover the image and with a minimum of 60% opacity so as to render the product unusable by anyone who has not legally purchased it.

4. You agree not to purchase or download products from our site(s) and relist them on your site for sale or free and claim them as your own. This is something we take VERY SERIOUSLY and we WILL report you to the Federal Authorities and seek prosecution.

5. Due to the nature of our business we will not offer refunds on any purchases made for intangible products on our site. We will however make every effort to ensure that your purchases can be downloaded and delivered to your computer. In regards to physical products, a request for a refund must be made within 10 days from the date of delivery and all materials must returned as they were originally delivered.

Some Examples of ACCEPTABLE USES for our products:

A: We permit the use of our product on sites such as Cafepress where they can be used in part or in whole to create T-shirts and other apparel, accessories, hats, mugs, buttons, etc.

B: You are permitted to combine our products, either with other products from GCW or another designer, to create candy wrappers, scrapbook pages, or other items with the intent to resell them in either digital or physical format. EXAMPLE: You use one of our graphics, and a wrapper background from another website, to create a new candy wrapper. Provided the terms of use for the background allow it, you can then resell your new candy wrapper on your site, print it out as a kit to be sold physically, etc.

C: Somebody on a forum, WrapCandy.com for example, asks for an image of a car, and you have purchased one from us. You are permitted to post either the products display with the word sample over it as described above, or a single image with the word sample over it as described above, to show what can be purchased on our site. Alternatively, you may post a link to any product on our site.

TERMS OF USE FOR RESELLERS ONLY

1. You may not sell these products you add to your site or have us add to your site, for less then we offer them on GotCandyWraps.com

2. You may not  offer memberships allowing members to mass download any products you have added to your site from GotCandyWraps.com

3. You are permitted to post displays and one sample image with the word SAMPLE covering at least 50% of the image on egroups, newsletters, forums, and other places to show people that you have something and direct them where to find it on your site.

4. You may not post, send, share, or otherwise make available for download any products from GotCandyWraps.com to those people who have not rightfully purchased the products from your site. You are permitted to make the freebies we offer on our site, available on your site as freebies.

5. GotCandyWraps.com RETAINS the copyright for all products on this site, and those products you offer for sale on your site that were created by GotCandyWraps.com. You are not permitted to claim them as your own, offer them in a compilation for mass download ( see #2 above ), distribute them in physical or digital means under another name, or otherwise take credit for the work you did not do.

6. You are permitted to have sales that coincide with ours. This means if we have a 50% off sale then you are permitted to have a 50% off sale as well. Other sales can be approved and to do so you will need to email us at: info@gotcandywraps.com and let us know what you are planning.

7. You are permitted to use our displays if you want, or create your own displays from the images in the packs. You must ensure that the images used on the displays can't be seperated from the backgrounds and they must be in locked format.

8. GotCandyWraps.com reserves the right to modify, reword, add, or delete from these terms of use as needed and we see fit without need for prior notice in order to protect our work. Your compliance with these terms of use is mandatory for participation as a reseller and failure to comply with these rules can result in a warning or termination of your license without recourse for a refund of any fees paid and possible legal action.

9. YOU ARE NOT PERMITTED TO OFFER RESALE RIGHTS ON any products from GotCandyWraps.com. If you are wanting to offer products for resale please visit Graphtastic to purchase packs theres you are able to resell.

10 You are permitted to sell individual images at a rate of $0.75 cents per image, you can also break up the graphics packs and wrapper sets to make your own but if you use any products from GotCandyWraps.com you may not offer resale rights on those items.

The goal is to help you make money, the rules are in place to protect not only our work but your investment and to ensure that you are able to offer our products in a semi-copetitive environment which will maximize your potential to make money.
